There is a residential property owned by my Dad, Mother and Sister in a co-operative society in thane.My dad died a year back
WITHOUT any WILL. We now need to
1. transfer my dad's portion(33%) to my mom and lATER
2 mom will then 'gift' 33% to me
I enquired with the Secretary of the society . He mentioned that for step 1
Both me and my sister will have to sign an affidavit and also will have to print ads in local newspaper.
He then informed that a probate may be required...
Please let me know the right process and documents so that later on there should be no issue while selling the flat
