Civil suit - succession certificate

Hi Everybody, One of my friends father private employee passed away 2 years back intestate leaving behind 2shop and a house now the family want to transfer property on there name.. -Death certificate issued by municipal authorities.. -MRO is not issuing dependent/legal heirs certificate and telling them to obtain succession certificate from court.. Please advise for succession certificate and court fees and advocate fees..

If MRO has received such fees and there was a delay of more than time frame fixed under citizen charter, issue a notice under CP Act and file a complaint before District Consumer forum for deficiency of services.  The total costs may not be more than Rs.200/- if a party appears in person.

MRO is not taking application at all and saying earlier we use to issue dependent family members certificate but now we stoped issuing it except government employees.. go and apply for succession certificate from court..

If you are from Telangana state, if there is a possibility, apply it through mee seva.  File this as a grievance with MRO in writing and get acknowledgment.  Also file RTI Application to State Public Information Officer, District collector and seek information as follows:

Information solicited:

1. Please provide the certified copy of order/notification/circular/directives that states that MRO issuing legal heir certificate for the general public is barred and no more in force and that states that legal heir certificate has to be taken as succession certificate from the competent court.
