Non owner as president of association

Hi,

In our association the President does not own property on his name as it belongs only to his son. But he has become President of Association is this legally allowed and if any owner of the flat/member in the association who owns the flat if objects can he still be valid to this position.

Reason for asking is all decision is being taken monopoly by himself without discussing with association members like fixing maintenance charges etc.

He is been President for more than 3 years still holding the position and he never responds to issues when addressed in maintenance and it is like we are bound to listen and adapt his decisions.

Please help to overcome and need him to leave soon

Dear querist, it is a registered association?  Then all the members shall follow the terms and conditions of the byelaw.  If no meeting is conducted for election, make a complaint (shall  be signed by other members) to the Registrar concerned.

This is registered association.

Except two to three members others are NRIs and they are interested only in getting rents not much bothered about internal problem and this has become advtange for the association committe.

Since I raised my concern in the whatsapp group where all owners are members I have been removed from the group.

Please advise to which Registrar need to submi the complaint as the property is in Chennai.

Also is the President legally allowed to be in this position as he does not own any property on his name

If it is registered under Socities Registration Act then you have to complain the District Registrar of Assurances (Registration and Stamps Dept) and if registered under Coop.Societies Act, Deputy Cooperative Registrar of the District.

A person who does not own, either individually or jointly, a flat in the society can not be elected to the Managing Committee let alone being the Chairman. You should submit a written complaint to your association and endorse a copy to the Dy.Registrar of CHS of your zone setting out the whole matter.
