The flat owner obtained NOC for sale of his flat from CHS built by CIDCO but later on flat owner decided to sale his flat to another person who was ready to pay all his sale amount at one time and immediately. And flat owner returned booking amount to earlier person by deducting the expenses( Rs.50k)occurred while obtaining NOC from the society and now the owner refuses to pay that 50k to earlier person with whom owner cancelled the deal. Owner is saying that if society will return me that 50k then only I will give it to you. In this case is society bound to return 50k to flat owner as that earlier NOC got cancelled?
