FIR registration

Dear Sir
my query is regarding to FIR.when fir is lodged by any person or govt.dept.what is general process.and if fir is lodged without evidence can anybody defend such injustice and what is the method

When the F.I.R is registered police starts its investigation based on the complaint received, after investigation if there is no evidence against the accused named in the complaint, then Police may file a B summary.

FIRs are filed, the case is investigated upon facts of the case, relavant evidences and connected witnesses.

If all these three do not exist then a mere complaint will be eventually dismissed after completion of investigation.

If you are victimised by false case if you prove the allegations in the complaint is baseless or not at all constitute that offence then you may go for quash petition before the concerned High Court under sec 482 crpc.
