Is the nominee a legatee or trustee?

A person had made an life insurance and made his brothers daughter as nominee with an intention, that the insurance amount should be given to his brothers daughter. But now his real daughter came forward that she has right and no money should be given to her cousin. Is there any law in favor of nominee please enlighten me?

Nominee is only a trustee.  The nominee has to ultimately pass on the property (movable in this case) to the legal heirs.
