Ep at district court

Regarding Partition Suit, Final Decree has been received for equal partition. Now the defendants has appealed in high court. It is 2 years and is only under AS number state and case is not proceeding. Stay has not been given. Now can we apply for EP at the lower court.

Until opposite party does not get stay order from appellate court,you are fr�e to get executed the decree.
