Subsequent to filing of an application for grant of trade mark, if no objections are filed by a third party, whether the mark will be granted automatically by the Registry suo motto without hearing the applicant further, or will the applicant be heard before grant of tm?

ofcoz, after scruitiny of your application, your proposed mark will be published in official gazett, and within 3 months if no objections are being called for/raised then you will get registration.

thank you very much for your immediate response.What happens if formal objections are raised by the trade marks registry and there are no third party objections. how do we deal with the same?

contest those objections otherwise rectify thesame.


opposition by other parties  can also be filed afetr the registration.

for registration of a trademark unde use or proosed to be used by a proprietor has to be made in the prescribed form under section 18 of the Act.
