Forced_notice period

When i join the company notice period was 30 days (not mentioned on appointment letter) after that HR make it 90 days.
. Now i have resigned from the company and on notice period. I am ready to serve 60 days and ready to pay for remaining 30 days.

I being told to serve 90 days without that i will not get relieving letter and if i quit early after 60 days they will treat this as absconding. my next company would like to join me as early as possible. Also I can not use my leave against notice period as per co policy.

Please suggest can i sue my company under any law for this.which document should i go through before lawsuit. 
its like mental harassment. 

Biggest question is who decide final day whether its HR manager or reporting manager as per company policy.
HR blame reporting manager and reporting manager blame HR for this.

Will appreciate any help on this.
