First Appeal under The Right to Information Act, 2005 can be made on following grounds as per section 19 of the Act:

1. Non responsiveness of the PIO within 30 days;

2. Unsatisfactory response from Central or State Public Information Commission as the case may be.

In your case, since there was a clear refusal to provide information, the Central/State Information Commission has the power to impose penalties on such Officer as per s.20 of the Act. 

Additionally, for each day of delayed information beyond 30 days, a fine of Rs. 250 is imposed for each day. However, the total fine shall not exceed Rs. 25,000.

please read section 11 of RTI Act.  Has deptt followed the same before resusing as 3rd party information.
