Do we need to pay custom duty for used phone

Can anyone help me know, whether we have to pay a custom duty for a used phone which got lost while travelling in Bangkok. Later the taxi driver found the phone and shipped the same by DHL to India. Now the DHL officials are asking for custom duty to release the phone. Please help me to know.
