the gurantator property has been auctioned and sale certificate has been issued to biddder by bank.still physical position is with gurantator.the gurantator approached drt and the xx amount has been deposited and the sale has been set aside. Further the bidder and bank challenged at appplet court and the sale is recovered .again the gurantator approached high court and the writ petition is pending.
the gurantator has sold the property to third party and executed regesterd sale agreement by taking part payment . In this scenario all three parties ,the gurantator ,biddder and third party wants to compromise out of the court .
in this regard could any one advise the leagal way to transfer the property to third party.
