Section 80 C.P.C details

Dear All,

 

My wife filed complaint and police registered FIR U/s 498A and 3&4 of Dowry Prohibition Act.

Some facts:

  • FIR is U/s 498A only,
  • Arrest of accused U/s 3&4 of D.P. Act and 498A IPC.
  • Remand to judicial custody is U/s 3&4 of D.P. Act and 498A IPC.
  • Charge sheet is under 498A only.

 

  1. Can I ask for compensation from police for not investiagting the matter properly and arresting me u/s 3&4 of DP Act.
  2. Shall I ask police to initiate proceedings against complainant nad witnesses who gave false information to police to make me arrest u/s 3&4 of DP Act.

Kindly let me know how to initiate proceedings U/s 80 C.P.C. Does my case suits to file this proceedings on police and on the complainant nad others.

You are confused.  Since charges are made against you, you must face the trial by the court.  Section 80 of CPC has no relation to cases you are facing.  Better consult a lawyer and understand the basics of the law.
