Protected tenancy

Hello 

this is Ram from mahabubnagar district here would like to share few lines with you about a civil issue .

there are four real brothers(1,2,3,4) all are having together combined land and all got their names in the 1951-1952 Khasra pahani , in the year 1968 one brother(3)from the four, filed a petition for partition ,with in two months from the date of OS all four brothers  with mutual consent and understanding compromised with out any costs and divided the property equally among four brothers, with every one consent and they satisfied with the share fallen to them. Court decree was issued in 1968.

now the problem is brother no 2 is entered as Protected tennant record of only one survey number which is fallen into the share of brother no 3.

In the year 1988 the person who is recorded as Protected Tenant (brother no 2) given one resigned or surrendered note on 10rs bond paper saying that "I am resigning the Protected Tenancy" and also mentioned that " remove my name from the Tenancy record ". But brother no .3 with belief not given court decree paper and surrender note to Tahasildar.

Now still brother no2s name is there in the Tenancy Record only not there in the pahanis since 40 years and not there in the possession from last 40 years.and brother no 2 and brother no 3 both are no more .only legal heirs are there.

so now the question is what is the procedure to terminate the Protected Tenancy ,the court decree copy which was issued in the year 1968 ,and Surrender Note are useful or not .

You need to file case for getting relief against tenancy rights.
