can anyone out there please help with some case:-

-in which it is laid down that shall be is equal to must be???

-in which High court has deferred frm its earlier decision and have aquitted the accused(here the facts of the case is similar)

Dear its not the way to aks the query, please provide the particulars of the offence, whereon you need the opinon. Becasue noone has so much time to waste. If you narrate the particulers, the same would facilitate and make it easier.
