Notarized rent agreement or registered rent agreement

Often People gets confuse about these two terms that Whether to make their Agreement attested from Notary Public or make it Register.

Generally its the Mutual Decision of Landlord and Tenant that what they want to do and also it depends upon the purpose of the Agreement.

This is what Actually it depends on:

  • If the Agreement is making for 11 months than notarizing it with Notary Public is sufficient and Valid.
  • If the Agreement is making for above 11 months then it is recommended to Make it Register as the validity for Notary is for 1 year in case of Rent Agreement.

West Bengal and some other states have separate tenancy act. Agreement not irised. Tenant does not want to leave the apartment. You are to take recourse of law for eviction. For transfer of property registration is a must. In other cases it is choice of both parties. Supreme Court petition can be filed after noterisation.non judicial stamp paper agreement with attest action by nitery public is sufficient. The tenant is entailed to get monthly receipt of rent paid.law is bit complicated so far eviction of tenant is concerned.registration of a document doed not cost much.
