Notice period clause

Hi Team

I was working with ibm since 2013.I resigned IBM on 20 the Jan.As per notice period 3 months my tentative last date in IBM is on 20 th april.But my manager released me on 9 th feb 2016.

As per offer letter you or company may terminate your serivice my giving 3 months notice period or 3 months basic salary instead.But My manager is not willing to pay for notice period not served

Did you submit noticed of resignation and mention clear notice period of 90days in it/LWD?

Do you have the copy and POD?

Did yur manager relieve you in writing?

If yes, the merits are on your side.

The inner/private wishes of the manager does not matter.

 

Is your manager your employer?

 

You may narrate all representations (mention names/dates/brief minutes) under proper acknowledgment  addressed to good offices of appointing authority,MD, Chairman and raise your demands.

 

Get acknowledgment of notice, acceptance, relieving letter, service certificate, handover of charge,NOC/NDC, correct FnF statement (dedcline to accept in writing if it is incorrect), PF a/c statement, Form16 as per correct FnF statement, etc in your hands.
