Maintenance charges for flats

Dear Sir,

 My son opwning new flat in chennai.The sq ft of the flat is around 2150 and totally six flats Out of which 4 flats are 1580 sq ft and other two 2150 sq ft. My question is as follows. Now maintenance charges are to be paid monthly for the following Security salary, sweepping of common area, Maintenance of Genset and Lift.Watering of landscape and watyer pumpting to the overhead tank daily.

Is this to be borne equally by all the co-owners or to be shared by all depending upon sq ft of the flat they own. Kindly inform what the laws says about this. Kindly enlighten me.

Hi,

There is no specific law govening the maintenance charges of the building.. it has to be decided mutually by the members or the co-op housing society if any.. generally the charges are calculated on the sq. ft area of the flat.

Sir,

Even though the size of the flat is different in Sq ft the facilities for which manitenance charges are paid is equally enjoyed by the flat owners.The Sq ft highjer sized flat owners are not enjoying more in the facilities. Under these circumstances Will charging as per Sq ft of the flat is maintenable under law.

We are 6 flat owners of differently sized flats.Two flats are of size of 2146 sq ft and 4 of 1580 sq ft. and we have not formed any association and yet to form. It is newly constructed flats. The four flat owners are demanding maintenance charges at Sq ft rate where as other two flat owners are willing to pay as per flat basis irrespective of the size of the flat for the simple reason facilities out of maintenance are shared equally by all person and the higher sized flaty owners are not getting anything more benefit out of it. Advice as to which calculation to be followed.
