Change date of birth in indian passport

Respected Sir/Madam,

My spouse, whose passport was issued by the consulate general of India in san francisco, needs to fix her birth date in the indian passport. We have her birth certificate with the correct DoB of 30th Oct 1983. Her DoB in the passport is 13th April 1983. One of the documents mentioned in the documents checklist of the website https://passport.blsindia-usa.com/changedob.php is a "Court order issued by a judicial officer of 1st Class Magistrate in India and Competent Authority issuing an amendment or correction in the date and place of birth of the applicant". I read in one of the forums that if the disparity in the birth dates between the birth certificate and that in the passport is less than 2 years, then a court order might not be required. Is this the case? If we do need to obtain a court order, what is the procedure we need to follow to obtain one?

For correction of date of birth in the birth certificate by the Registrar of Births and deaths, an order by the magistrate on the petition filed by the petitioner, shall be the authority to effect the change in the register and issue an amended birth certificate.  

The said less than  two years difference can be approved by the Indian consulate itself at abroad who may be the authority to renew the Indian passport at that place.
