Can open terrace in a flat/building be sold to any resident

we have come to notice that a flat owner has claimed rights to terrace and has been in pocession of the same since 1988. however since i have moved in and become the secretary of the association i have questioned this act and now want to know if have done the right thing and how am i supported by law

A. No, terrace of the flat would be treated as common area and all the member of the flats are having equal exclusive right over the terrace.

B. Therefore, neither association nor builder cannot sell the terrace portion to respective flat members because of common area.
