Ques. on ipc 505.. pls help !

Dear Experts,

Mr. ABC (a Municipal Councilor / Corporator) in Mumbai of a particular Ward. In that Ward many Commercial Entities do Illegal and Unathorized things happen which is clear cut against the provision of Law. Mr. ABC and Municipal Authorities don't take any action against such thing. Mr. ABC take bribe or money from such comericial entities and ensure no action shall be taken. Now we want to move to file a Legal Case in this matter.

My Question is:

1) Can IPC Section 505(1)(b) or 505(1)(c) work in this Case?

2) Does Permission of Municipal Commissioner or any other Higher Authority is necessary before filing the case against the Municipal Councillor?

3) Is there anyother IPC Section?

Kindly help in this matter.

Hi,

Firstly you don't need to have any pemission from the Municipal commissioner to file a case against the corporator.

Check whether the coroprator is directly or indirectly involved in such illegal activities?

Can you explain the illegal things which are happening? Because we have to see the nature of those offences to decide the exact provisions of the IPC.

Dear Sir, thanks for your Response. In my ward, In a Residence / Slum Area many people are constructing Gr+2 floors or height above define height limit in unauthorized manner. Also converting the use of Residential unit into Commercial and Industrial Units. Mainly of Garment Manufacturers. Almost 60% of the Residence area is converted into commercial hub. The Corporator take money from these commercial entities and residence people any ensure no action shall be taken further. Municipal Authorities also don't take any action in these regards. Its about one to two year we are complaining in this regards. Kindly guide.
