Land document

Dear sir, i had purchased a land during 1987 from a known person which was owned by her. but the back document for this deed says that this property was acquired by one of the sisters by paying certain amount to other two sisters through a mediators arrangement. this property belongs to their mother after the expiry of her father. The issue is there was one brother for these sisters who went missing for more than 30 years and in spite of any amount of efforts he is not traceable or he did not come back. This detail is recorded in the sale deed, Hence this property was taken possession by these sisters. Now iam keen to sale House constructed in ths land i.e in year 2015 .s far me concerned i have given my sale deed plus the previous one in which this missing persons details is written. i have been issued possession certificate also and kriyapthiram in kerala , Palakkad (by land tribunal ) where my property is located.now please let me know whether my selling of property will have any legal roblems due to the missing person ( now his missing is about 60 yrs) and already 2 buying transactions are over during this period. Kindly clarify. Rajendran

Mr.Rajendran, there should he a release deed or relinquishment deed from all the legal heir favouring one legal heir, in case all of them are willing to relinquish their share on the property, in your case i think it is not done properly, kindly insist for the same now.  if a person is missing it is always  safe and better to seek court declaration , that if any person is missing for more than 7 years he may be declared dead by the concerned jurisdiction court. Mutations of records will only substantiate your residential proof.
