Divorce with working women

If wife herself deserts husband and seeks divorce, there is more likelihood that she will not get divorce from the court because the fault is with her.   She will also be not entitled to maintenance and more over she being employed, cannot get maintenance.  If husband  also desires to have divorce decree in such circumstances, the better way for both of them is to go for MCD with an agreement that she will not be entitled any permanent alimony.

Supreme Court has clearly stated that no alimony or maintenance of a well qualified and employed wife.A qualified wife cannot sit at home idle and claim maintenance from husband.

It is not right decision to take divorce fron your husband.you should coperate each other and make sensible decision.

Thanks for the information. Since if wife is not coming to make a family for more than one year siting reason as professional job contraints if we approach court that she's not joining husband will there by any problem for husband. Also is there any possiblity that she can put any case on husband like harassement etc., as retaliation to case filed by husband? (Note: Husband and wife were together only for 3 weeks after marriage 1 year back).

Kindly advice.
