Mhada flat - title transfer

Between 2000-2005, we purchased a MHADA flat for my husbands family. The title was in my husband's aunt's name since his parents were ill equipped to handle the legalities and we live in the US. The understanding was that she would transfer the title to us when requested. She is now refusing to do so. Her excuse is that the society will not transfer the shares until she dies. What are our options to the get the title transferred without conflict? We made all the loan payments on the flat.

1.   The Title can be very easily Transferred via a duly paid Stamp Duty and Registered "Gift Deed", subject to the willingness of the present title holder.


2.  IF the above is not possible THEN file a civil matter for possession, based on the property purpose documents and payments made therein.

Thank you for your response. His aunt has previously quoted us a ridiculously exorbitant cost for Stamp duty. What would be reasonable stamp duty for a mhada house in andheri, not more than 1500sq ft.

Thestamp duty details are local issues, it may either be enquired through some local consultant or can be had from the government registration department's web site.
