Hi,
My father have built 3 small houses in 30:40 site and he expired in Sep 1998 without writing any will, After 3-5 months my mother and brother told to sign a document telling this is an affidavit. They had agreed that my sister and me will stay in two houses.but now my mother is not allowing to stay. Can I claim towards my partition in the house. please advice.

You are eligible for equal share, you can claim the same, in case if you have not relinquished your rights vide registered document.

A. You have equal right as rightly pointed out by learned collegue Mr. Raghavan Srinivasan, you can file a suit for partition before the Court and file an application under order 39 and 1 and 2 not to alienate the property till disposal of the suit.
B. Your brother don't have right to sell the property unless released your right.
