Process of transfer of agricultural land to nri

Dear Sirs

 

I have a question in relation to property transfer to a NRI.

My father bought some agricultural land in early 1980’s via remittance of cash to my uncle. Both their names were supposed to be added to the ownership deeds. 

He has now learnt that my uncle never added his name to the deeds. He says it was not allowed for NRI’s to be added to land deeds back then is this true?

 

My uncle has now agreed to transfer my fathers name on to the land deeds as sole owner. How is it best to proceed with this? Can some one provide some detailed advice also mentioning possible issues? Should transfer be via gift deed? And what would be approximate cost and time for this process.

it is correct that NRI cannot purchase agricultural land

however as already agreed upon the best way is to get it registered by way of gift deed

regarding the expenses the stamp duty varies from state to state 

gift deed is the best and involves lesser stamp duty
