All respondents/acussed to be present

Both the parties have come to settlement in 498A & DV Cases but the co-accused of Respondents are not appearing despite summons/warrants which is causing delay in framing charge & Final Judgement.Is it necessary that all respondents to be present framing charges/Judgement.Please reply.

Thanks for your prompt reply.Can you please elaborate in detail since these co-accused are deliberately not appearing since they are having bad motives.

Alternately the court may moved for splitting of the casea nd the non appearing respondents may be taken into the split case so that the current case may be disposed as per the present proposal.

Thanks a lot for your expert advices, It meant a lot to me.Luckily all respondent arrived this time & Charges framed,Petitioners made hostile & now Case is Settled with Order Sheet prepared by Hon.Judge.Some disputes raised but Hon.Judge impelled to end the dispute on a happy ending note.Only waiting for final judgement in few days.
