Does notary document have a legal value if ....

Respected to all Sr. learned Advocates 

 

Does Notary Document have a legal value ??  If that document is not registered under indian registration act in register office

 

E.g If There is Sale deed document having notary registered ......  then does it have value ? ...... how much evidentiary weightage to that that document or article ????

The Section 139 of Code of Civil Procedure 1908 has an express provision, in this regard, where any affidavit verified by notary is admissible as evidence. Likewise, Section 297 of Code of Criminal Procedure provides for admission of affidavits verified by the notary.

Till Affidavit is admissible as evidence .

but what about Sale deed Document or Any deed of conveyance document ? .......

If those documents are registered with sub-registrar. It is valid.

For transfer of title in case of immovable property,the Sale Deed is to be mandatorily registered with the District Sub-Registrar's office and as advised above notarised document does have any credence for this purpose.

The notarised sale deed document will not confer the title to the purchaser nor the transaction will be held legally valid.   It is mandatory to register the sale deed executed by the vendor in favor of the buyer before the concerned Registrar's office.
