where does the cause of action lie when someone like Gandhi is defamed? (in relation to criminal defamation of dead) Who can initiate criminal proceedings against such offender? Could it be the political party related to such person who is defamed, in their official capacity or can any one else, not related to Gandhi, start criminal proceedings in their individual capacity?
