An individual. who has been imposed major penalty of Compulsory Retirement and whose appeal has been rejected by the Appellate Authority under CCS(CCA) Rules, does not have any source of Income. If he files a case in CAT, disposal may take years. Please advise, whether he can opt for pension under Protest and simultaneously fight case in the CAT. and if he wins, pension amount till disposal can be adjusted against the arrears of salary he will get.
