Withdraw counterclaim of rcr and file div on desetion

Dear Experts,

My wife filed divorce on cruelty. 13 1 ia wihtin 2 months of sepearation. I contested the claim & made counterclaim of RCR. 3 years passed & issues has been framed 3 months back.

Her allagation are not of serious nature its normal wear & tear of married. life. I m genuenly intrested in cohabitaion but she is refusing to cohabit.

Since last 3 yrs I was in hope of that one day she will join me . we have 3 yrs old son. I can still wait for her for 1 more year.

My Question is after 1 year can i withdraw my countercllaim of RCR & file fresh petition/counterclaim for divorce on the grounds of desertion?

I dont want to go for MCD coz her demands are very.

Yes, you can withdraw your petition and file a fresh petition but that will be a loss of time, again case will start from A, B, C, D..... Better bargain for best price in MCD and get rid of headache or convince her to come back for sake of kids future as kid needs not just mom but also dad.
