School tradename

HI,

I need clarification on the lawpoint related to the following issue:

Parent's of the school's students have formed an association in the name of the school e.g. XXX School's student's parents have formed an association "XXX Parents' Association". Will it be a violation of the registered trade name of the school?

Kindly advise.

Yes, unless allowed and authorised such by the school. The School should be represented on the board of such an association.

But i would like to mention here that the parent's association is not registered with any government body.

Will it be the same case as told by you. Also if you can provide me with any reference of a court judgement.

1) Registration - or not - with any body may not change the situation wrt  trademark violation.

 

2) can't  give a court judgement off hand , but search for " passing off " or " infringement "  violation in Trade Marks Act . See, for eg., a good explaination at :
