Lab report ignored by consumer comm.

Sirs

As per section 13(1)(e) of CPA Govt. Analyst has tested sample and reported it to be of STANDARD QUALITY.

But State Consumer Commission, relying upon the photographs and the opinion of Beauty Parlour owner

has held that liquid soap has caused damage to Hair.

      While u/s 13(1)(g), the order is to be based upon the Lab. report only.

               Kindly advise and share the relevant judgments.

"u/s 13(1)(g), the order is to be based upon the Lab. report only." The above contention is not correct. Things are not as simple as that. No law will say that a laboratory report is to be accepted blindly in to to. The section gives an opportunity to the contending parties to give their own opinions on the report. The judgment will be based on the report, the opinions and arguments presented by the parties and on the reasons given by the judges themselves for the judgment. It is possible to give an opinion only after seeing every thing.

The order of the consumer forum is to be seen for rendering an opinion to that.
