This is regarding a co-operative housing society laws in Pune Maharashtra.
two questions
1) Recently our society has passed a resolution in SGM to charge developmental charges to members of society who sale the flat to new owners an amount equal to 2% of sale value. As per my information from Model bylaws published by Sahakar Ayukta, transfer amount which society can charge is ONLY 25000. Can you pls advice if society resolution is legal?
2) Society in its SGM has passed a resolution not to let out the flat to Non Family members or if Non family members are kept then only keep 1 member per 1 bedroom apartment (it if it is 2BHK flat then only 2 members are allowed). Does society has legal right to make such restrictions?
If society is not have such legal rights, can any legal expert advice next course of action I can take?
