my grand father's(G1,G2) had a house which was ansistral property. there is a well in that house which was situated 3/4th on our side(G2) and 1/4th on G1's side. our great grand father registered a partition document in1960 stating that there is a water right for G1 in that well. in 2002,G1 built a new house without touching well.now my grand father(G2) is going to construct a new house.but now G1 objects to destroy the well on grounds that there is a right of water in that well. without closing it it is impossible to construct the house.
please suggest any solution for this problem.
