Status of crminal complaint

I had entered into a Tri Parte Agreement with a Govt Department and a Firm for supply of some material under government scheme. The Firm after taking a sum of 5,00,000 (Five Lacs), refused to supply material and i had filed a complaint against the firm in police and Govt Department and had initiated a complaint case U/s 156(3)/200 CrPC.

The Firm had deposited a Bank Guarantee of Rs. 10,00,000 (Ten Lacs) with the Govt Department.

The Government department has decided to refund my money by encashing the bank guarantee of the firm.

Now what will be the status of the complaint?? I want to pursue the matter and get an FIR registered for cheating, but will concerned magistrate refuse to do so saying that my amount has been returned so the FIR is an exercise in futility??
