Salary not paid by school

 

My sister joined a school as Assistant / Primary teacher on 15th April 2014.

 

Due to some unavoidable reasons, she offered her resignation from the services on 18th July 2014 and requested to be relieved at the earliest. This may pls be noted that she was not been given any formal appointment/contract letter despite repeated requests for the same during this tenure. On the same pretext she was being informed by school that there is no need for the resignation and she will be relieved after getting clearance from all the departments and will get back original certificates submitted at the time of joining. On confirming about salary dues, she was also being told that the same would be given after 7th of next month i.e. after 7.8.14.

 

As per the instructions being given, she took clearance from all the departments and got her originals back. But on enquiring about her pending dues, she is not getting any proper response.

 

Multiple requests are being made on emails which were never replied by school.

 

A speed post formal letter was also delivered in this regard in the name of the principal.

 

The salary dues are for total 15 days.

CHAPTER- II:3. Norms for Affiliation:

3: (V) The school in India must pay salaries and admissible allowances to the staff not less than the corresponding categories of employees in the State Government schools or as per scales etc. prescribed by the Government of India.

 

10. Staff and Service Conditions: 2. Salary should be paid through Account Payee Cheques drawn on a scheduled bank, from the

date of first appointment of the teachers on probation.

3. The school should have well defined conditions of service as per norms of State/U.T.

Government and should issue letters of appointment to the employees at the time of joining service…….

 

8. The Management of the schools shall not retain the original degree/diplomas certificates of the teachers and other employees of the school with them. The original certificates etc. taken for verification shall be returned at the earliest after verification. Photostate copies may be obtained from the employees and kept in their personal files. .

 

17. Withdrawal of Affiliation:Provisionally Affiliated Schools

2 a. Proceedings for withdrawal of affiliation may be initiated by the Board in case the schools are found guilty of following after reasonable notices :-

i) Not paying salaries and allowances to teachers and other employees, at least at par

with those obtaining in State/Union Territory institutions; default or delay in payment of

salaries and allowances.

18. Withdrawal of Permanent/Regular Affiliation

(1) Within the general frame work of Section 17 of this chapter, the Board reserves the right to withdraw regular affiliation in the event of a school failing to observe affiliation norms and rules

 

21. Powers and Functions of the School

Management Committee

1. Subject to overall control of the Society/Trust, the School Managing Committee shall have the following powers/functions:

iii) It shall look into the welfare of the teachers and employees of the school.

ix) It shall ensure that the norms given in the Act of the State and by the CBSE regarding

terms and conditions of service and other rules governing recognition/affiliation of the

school are strictly adhered to.

CHAPTER-VII

SERVICE RULES FOR EMPLOYEES

24. Short Title

1. Each school affiliated / to be affiliated with the Board shall frame Service Rules for its employees which will be as per Education Act of the State/U. T.

 

26. Medical Certificate and Character Certificate etc.

1:(C): c) Original degree/diploma, certificates along with certificate(s) of experience, if any; with attested photocopies thereof. Original certificates will be returned after verification.

 

27: Probation: 2. If an employee desires to be relieved during the period of probation, it will be necessary for him to give one month’s notice in writing or one month’s salary including all allowances unless and otherwise the Managing Committee permits ,relaxation under special circumstances.

 

35. Contributory Provident Fund - Pension Scheme

1. Employees except those employed in temporary vacancies and on part-time service, will be required to become members of the Contributory Provident Fund Scheme as required under the employees’ Provident Fund and Miscellaneous Provisions Act, 1952 or shall be eligible for pension and gratuity, if adopted by the school.

36. Representations

1. Representation to the Managing Committee, Chairman of the Society or Manager may be made only through Principal in case of teachers/other employees.

2. The Principal may submit his representation to Managing Committee/Chairman of the Society through his next higher up- Manager/Correspondent of the School.

 

43. Service Books and Confidential Rolls
