Statement u/s 243(1)of crpc :is cross-examination allowed

Hi All,

 

If the Accused in 498A case is filed Statement U/s 243(1) of CrPC after that Accused not entered for giving Defence Evidence will the Court allow the Prosecution to Cross-Examine the Accused based on the contents of statement U/s 243(1) Of crPC......

Yes he can be examined, but not under OATH.

Dear Sir,

I am not understood fully .... do you say based on the Statement U/s 243(1) Court will allow the prosecution to cross-examine the Accused who field the Statement U/s 243(1) of CrPC .....

 

Condition that to file Statemet U/s 243(1) of CrPC there is no need to file permission petition U/s 315 of CrPC ..... in the absence of petition U/s 315 of CrPC can the accused enter into witness box to give evidence under Oath follwed by Cross-Examination ....?
