Police rti

Can an RTI be filed against a constable who has been in a particular police station for last 8 years.

If yes kindly guide me with the procedure . The purpose of RTI is to enquire why the constable is at that station for 8 years and not been transferred to any other station.

You may ask for policy regarding posting X person at A partuclar police station.u/s 6 of the RTI Act.,2005. No one will give to explaination for "why", since the law provides for information and documents.

You can structure RTI Application without mentioning any name.  You have to file application seeking information under RTI Act as per format  and fees asprescribed by State .  A simple format is as follows.

Application dt....................seeking information under RTI Act, filed

Before Public Information Officer, Supdt., of  Police................(name of District HQ) with

RTI fee:Rs.10/-  (as prescribed by state RTI rules and regulations  Court fee stamp/Indian postal Order)

Applicant:.......................................(advisable to ask some body to file application on your behalf)

Brief Facts: Prescribed norms/directives/circulars applicable for transfer of Constable from one station to another station.

1.Please provide a copy of circular/laid down rules and regulations on transfer policy of Constables, stating retention period in each station etc.,

2.Provide the names of constables who were continuing more than the prescribed period under directives and reasons available on record for retaining them in same station, over and above prescribed norms.

3.If  any constable is over retained, the authority who is empowered  to order for over retention without transfer against a laid down policy.

(Send application by Regd., post and preserve office copy with proof of payment of RTI fee and service proof)

I agree with the views and opinions of above experts on the issue.  You can very well ask question through RTI but in general and not particularly about any individual which may violate the privacy of the individual.
