We live in Noida and had booked a unit in a prestigious project on Sohna Road Gurgaon in 2008. Although possession was due in 2011, the possession is being offered now but with below anomalies:
1. Instead of offering actual possession the builder is offering only permissive possession. The builder is getting us a declaration signed that no liabilities shall accrue to builder even while offering us permissive possession. Is this legal.
2. While as last payment due was around 5 lacs, the builder has raised a demand for appox. Rs 10 lacs, by enhancing the super area to 1755 sq ft instead of 1600 sq ft.
3. Penalty against late delivery is being offered @5 rs/sq ft on 1600 sq ft only and not on the enhanced area.
