ESI Act

Hi friends!

I would like to seek your help regarding the issue that if an employee mets with an accident resulting in serious  injury and that employee is not covered under ESI Act as his salary is more than 10000, and we have mediclaim policy for that employee. Is he entitled for sickness benefit or disablement benefit under mediclaim and how much amount will he get under mediclaim. How does insurance company estimate the loss caused to employee.

Can he go in workmen compensation Act to claim benefit as he received injury while coming for employment. What is the criteria of this Act and limitations.

Regards,

Learning
