Death of authorised signatory

Dishonour of cheques _ Death of authorised signatory _ Validity of cheques.

Cheques signed by authorized signatory issued for and on behalf of the applicants-proprietary concern _ Death of signatory before the presentation of the cheques _ Cheques could not regarded as invalid instruments as on date of death of the signatory qua the payee bank unless the death was duly intimated to the bank _ Unless there is tangible evidence to infer that the Bank was duly intimated about death of signatory prior to presentation of the cheques it cannot be said that the instruments became invalid.
