Divorce procedure



Can some one please help me out with the legal process for divorce and the time taken for the divorce to come through. the divorce is with mutual consent. And does the marriage have to be registered.

Divorce will be taken on two appearance but within six months.

it will be filed u/s 13-B and made a mutual agreement for divorce.

Dear Mr. Gokul, Supposing you have married as per Hindu Marriage Act, Adv. Kamal Grover has advised you correctly that under section 13B, divorce can be obtained within 6 months of filing the petition. For that, necessary condition is you must be living separately from your wife for a period of 1 year immediately prior to filing of petition.  A joint petition by husband and wife has to be moved and it will be heard after 6 months of filing. ddkharpudikar@indiatimes.com

Gokul's point whether marriage has to be registered for applying divorce has not been answered?

It is not required but only snaps and other evidence are sufficient or while filing of mutual divorce affidavit is also required wherein both will itself mention about the facts of marriage that is sufficient.

Further about one year term; At the time of filing the divorce, it is necessary to prepare a compromise deed and it can be filed only after one year, so everything will be mention in compromise deed by expert lawyer.
