Help me to get ancestor property

Hi, I am from Rajasthan. We (my mother, me & my brother) want to sale the ancestor property, we have succession certificate with us and my Aunt is asking for Equal rights on ancestral property. As per law, does she have equal rights to claim?

The property was register in the name of my grandmother ( Died in 1992 )

My grand Father Death- Oct-1973

My father - Died in 2007

My Aunt marriage – 1962

Let me know if any other details required. I will appreciate your reply.

Thanks in advance

If the property is in the name of the grandmother then, your aunt does have equal share in it along with your father. Your father's share will go to his legal heirs.

Thanks for your reply Archana ji.

So should my brother can sale the property without any litigation?
As in Rajasthan after 2005 is really becoming a big job to overcome with property issues, in any chance if she put any case on us in that condition we are not good enough to deal with that... so can you please guide me some more safety tip for this ?
