International law

Dear all,

I am working for a Shipping Company, wherein we undertake ship repairs.. One ship recently underwent repairs in our yard and the ship is ready to release.  Meanwhile, we come to know that the shipping company (foreign) has become bankrupt and not responding.. The courts in India has given seized / arrest orders on that ship, as the said shipping company owed money to others as well in India.. Unfortunately, we are one among them..

May I seek your idea of approach in the present case.. The Shipping company is a Offshore based.

I solicit your views on this urgently, as we need to initiate action against that company

REgards

Kiran

Tax and legal requirements generally dictate that the offshore company owning a shipping vessel should be incorporated in the jurisdiction whose flag the ship flies.
