Special leave petition

Under Art. 136 appeal is filled on the same facts or on the same issues?
Has issues to be same in SC which were in HC?

Yes - In a Special Leave Petition ordinarily no new issues are allowed to be pleaded, as it is an extraordinary remedy.

In High Court i was pleading for double jeopardy under art. 20 (2) but now in SC i want to plead for doble jeopardy under s. 300 of CrPC. Is it possible?
