Fixation of pay when post is converted to new pay

 

Subject: Fixation of Pay on conversion of posts to newly created posts.

Sir,

             I will be grateful to you if the clarification sought, is given a reply.  I am trying from the last 3 years which is not getting satisfied answer from any book or circular / order about the method of fixation of pay when post is converted to a new post.  

            Earlier in the Dept.  there were technical posts of DEO Gr. ‘A’ (pay scale 4000-100-6000), Gr. ‘B’ (4500-125-7000)  & Gr. ‘C’ (5500-150-9000). Next pay scales were to be given after every 3 years from Gr. A to B and from B to C.

 

Later in the year 2009 (14.10.2009) these posts were converted to DPA (Data Processing Assistant) w.e.f. 30.05.2009 (i.e. date of notification of the post in Gazette of India)

 Qualifications required for these posts of DPA (copy of notification attached):

 (a)       (i)   Degree in Computer Applications/Computer Science/ Degree in Electronics and Communication/ Masters Degree in Mathematics/ Statistics/ Commerce or equivalent.

       (ii)  One year experience in Electronic Data Processing work including experience in Actual Programming.

 

 

 

Please specfy how the pay will be fixed of Shri ‘A’ in the given (and he meets the qualification) condition:

 Post of Shri ‘A’ is converted as DPA (Data Processing Assistant) w.e.f. 30.05.2009 (i.e. date of notification of the post in Gazette of India) in the pay scale of Rs. 9300 – 34800 + GP 4600/-.

 Before this As on 30.05.2009 Shri ‘A’ was drawing 10180+GP 2800/- in the pay scale of (4500-125-7000 pre revised) and post was DEO Gr. B (Data Entry Operator Gr. B) 

 

A’s Pay as on 30.05.2009 = 

  10180 + 2800 GP

A’s pay was fixed on increment as on 01.07.2009   

  10570 + 2800 GP

But in October 2009 on his joining as DPA after *orders were made in October 2009 -

on pay scale of Rs. 9300 – 34800 + GP 4600/-. His pay was fixed as:-

 *orders for conversion were made in 14th October 2009

  10180* + 4600 GP

 

 

*Increment given on July 2009 was taken back.

 Now the problem is:

 1.            A is working in Head Office he himself and other DEOs in Head Office were not given options for fixation.  Even if they got their regular increment on 01.07.2009 in DEO’s pay scale,  it was also taken back and only grade pay of 4600/- was changed.

 

2.            But in other regional offices DEOs who were converted to DPAs were given option for fixation and in some regional offices their pay was fixed after giving one more increment.

 

3.            After giving so many representations A was given reply from administration that it is not a promotion but conversion of post. 

 

Now Head Office issued a Order (copy attached) dated 17.12.2012 regarding clarification sought by different regional offices on pay fixation which is as below:  

 

“The DEOs who were eligible for appointment / conversion as on the date of notification of the Recruitment Rules of DPA are allowed the pay of DPA notionally from 30.05.2009 i.e. the date of notification of RRs and with financial benefits from the date of assumption of charges”.

              

 

PLEASE CLARIFY HOW THE FIXATION OF SHRI ‘A’ WILL BE DONE AND WHAT WILL BE HIS DNI  AS ON 01.07.2009, 01.07.2010 & 01.07.2011.
