Two builder in construction agreement

Back Ground: 

There are Two Builders, each one of them is individual proprietor, Holding POA(Both) over a land. They started constructing the flats with MOU(Out of 8 flats, each one will share 4 flats in the same Project) between them.  A Purchaser apporaches to book a flat. 

Question1 : In the above scenario, can two Builder sign in the agreement as follows: One is sale agreement signed by Purchaser & By Two Builders as POA for vendor. The other one is Construction agreement again signed by the Purchaser and the Two Builder as individual Proprietor. 

Question2: Can the legal advisor(advocate) of the bank  recommend for the loan sanction to the purchaser?
