No will

Our father died without any will, leaving behind 1 son, 2 daughters and his wife. Now the our brother is demanding more share as against 1/4 of the share. MY question is - Can we sell our share of the property without our brother's noc as he is not ready to give up and because of this we all have not been able to tranfer property in our names equally.

P.S.  Our father owned 1 bunglow and 2 plots. Our brother is residing with our mother in that bunglow and we both sisters are married. We are thinking of selling the plots. Luckily we have the papers of plots, and our mother is on our side.

Firstly send a notice seeking partition. If your brother fails to respond or to partion the property, file a suit for partition.

ours is also a similar case. We have filed a partition case for more than one year. Usually, how much time it takes for the settlement of the case. N K Bajaj
