Insurance branch blocked IRDA agency license

Hi,

One of my cousin  has appeared for IRDA agency examination from Kolkata TATA AIG branch but the branch through which he has appeared for the exam denied to provide him the original certificate/license and said its TATA AIG and IRDA’s policy that if the agents did not drop any policies within fifteen days the agency will be terminated and there is no question of getting the license. They said they will not provide anything until and unless they receive the desired targeted policy from him. He just have only the hall ticket and mark sheet with him. Wanted to know if there is any law under IRDA that the insurance company can block the license after passing the exam and fool the agents with fake pressures.

Please help with a solution/suggestion at the earliest as the person is in a real fix and depressed. A help in this regard will be a great favor to my cousin.

  • The Company has a right to terminate the Agency.
  • You may contact IRDA for license.
  • Again, if you want to work for other companies, you have to get NOC letter from TATA AIG/

Neither, the Company can ratain the Certificate; nor it can terminate the agency. It is with the IRDA's discretion to cancel/ terminate on account of professional misconducts.

You write an application with a CC to IRDA seeking for the Certificate. If they deny to deliver the certificate, you may ask them to give all that in the writing over the same application and then submit the same to the IRDA.

It has been learnt that:

In each company there is a official designated by IRDA for agents agreements, licenses etc. This official forwards licenses to concerned employee in each branch office.

In each branch of the company there is an employee usually EA (Executive Assistant) or OA ( Office Administrator) who forwards agents docs to HO of the company and receives docs, licenses of agents from the company. The agent has to collect license from EA or OA or any other employee designated by the company, under acknowledgment.

The agency agreement which is signed by the agent is signed by the designated official of the company, on behalf of the company. In the agency Agreement Company might have given some target. The situation of business of the companies and recruitment of agents is such that agents are not terminated except in case of professional misconduct.

For all practical purposes agent can file complaint with BM. The matter reported by you is a tactics played by the company. Usually the companies exercise these tactics and tricks thru BM, who in turn forces the sales Manager/Agency Manager of the agent. This Sales Manager/Agency Manager of the agent is made scapegoat in all such cases. Sales Manager/Agency Manager as per process, compliance norms of the company can not collect the agent's license, but internally and verbally agent is usually told that Sales Manager/Agency Manager was holding the license. The agent is recruited by the efforts of Sales Manager/Agency Manager, and both may be known to each other. It shall be better to represent to BM clear the matter in complaint that license was declined to be given by BM as BM is the administrative head.

The agent should lodge a written complaint under acknowledgment with BM,MD of the company and mention his representations date wise, and request to supply him the IRDA license by registered post/speed post only, say within next 7 days. If the need be agent can lodge a grievance with IRDA.
